CALIFORNIA PROPOSITION 65

For over 25 years, Eagle Eyes has taken great pride in manufacturing high quality eyewear products for our customers that comply at all levels with the consumer product safety requirements of California’s Proposition 65, known officially as the Safe Drinking Water and Toxic Enforcement Act passed into law 1986.

Over the years, the OEHHA, the lead state agency charged with administering the law, has published a list of over 800 substances known to cause cancer, birth defects, or other reproductive harm. Under certain circumstances, businesses selling products to customers in California in retail locations, via websites, or mail-order catalogs are advised to provide “clear and reasonable warnings” before knowingly exposing people to any of the hundreds of chemicals on the list.

Prop 65 was intended to help Californians make informed decisions and it is important to note that the California government has clarified that: “the fact that a product bears a Proposition 65 warning does not mean by itself that the product is unsafe”. The government has also explained, “You could think of Proposition 65 more as a ‘right to know’ law than a pure product safety law.” https://oehha.ca.gov/proposition-65/general-info/proposition-65-plain-language

The California law established safe harbor levels for many of the chemicals listed under Proposition 65 when they are either determined or believed to have No Significant Risk Levels (NSRLs) for cancer-causing chemicals and Maximum Allowable Dose Levels (MADLs) for chemicals causing reproductive toxicity. Two such chemical on the safe harbor list are BpA that may be found in trace amounts in polycarbonate lenses, frames or accessories and phthalates used to soften plastics such as nose and temple pads. As a point of reference, both are commonly found in many everyday consumer products such as water bottles, food packaging, and personal care products including cosmetics.

Various nickel alloys also may be present in our metal frames and hinges but testing for safe harbor status by California authorities has not yet been completed.
